He was born 3 months after the marriage of his mother to his (legal) father Isaiah Culpepper. Isaiah was the son of Daniel and Jemima Culpepper. By the Aug 1852-Jan 1853 term of the Supreme Court of GA, both his parents were dead. During that term of court, Elias S. Wright, Jemima Culpepper's admr. vs. Lewis F. Hicks (Elmyra's husband), Case No. 28, decided that Barry was not illegitimate; but was probably the son of Elmyra's step-father. See the Daniel hard copy file for proceedings. Ltr 2 Apr 1983, Whaley/Nye: "... I've heard Joe's uncle Buck Daniel speak of an Uncle by the name of Culpepper being buried in Cuthbert." (Viola's husband Joe Whaley) And 17 Apr 83: "I know one of the Daniel's married a Culpepper & he is buried at Cuthbert, GA in the old cemetery."
